
TUCSON, ARIZONAÂ (April 28, 2026)Â – A 40-year-old man identified as Jesus Tapia has tragically died in a Tucson police encounter near Target on North Oracle Road.
Pima County officials are saying that the incident took place around April 4. Authorities received a report that Jesus Tapia may have injured himself with a possible box cutter during a mental health crisis.
Police arrived at a Target along North Oracle Road and encountered the man. Officers said that he made several statements that they described as unusual.
Shortly after this incident, Jesus Tapia called 911 and told dispatchers that he was being followed. Officers attempted to make contact with him again after receiving reports of a person throwing rocks at vehicles by Miracle Mile and Fairview.
He allegedly threw a rock at a patrol vehicle before he was shot with pepper balls. Another officer used a taser, which seemed to be ineffective.
At least one more officer used a taser before he was detained. He later went into medical distress before dying. A full investigation into the in-custody death remains ongoing.
Police officers have a legal obligation to use the least amount of force necessary for any given encounter. A police department could be liable for the excessive force of their officers. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Officers should take a number of measures if a suspect may be in the midst of a mental health crisis.
Officers should only use lethal force as a measure of last resort. However, even so-called âless-lethalâ options can be extremely dangerous in certain situations. This is particularly true with respect to tasers. A number of people have died after being repeatably tasered by law enforcement officers. Suspects who are under the influence of drugs or in the midst of a mental health crisis are particularly vulnerable.
Tasers and other âless-lethalâ options have resulted in a number of in-custody deaths. According to ABC 11, âThere have been around 500 fatal taser encounters with police between 2010 and 2021 across the country, according to Fatal Encounters. Â The number of annual incidents nationwide have declined since 2018 with 72% fewer fatal incidents reported in 2021 than in 2018.â Certain steps should be taken after any in-custody death.
It can be difficult to know where to begin after any person dies in custody. To make matters worse, police departments will virtually never accept responsibility when someone dies in their care. When these police departments investigate themselves, they will nearly always find their officers did nothing wrong. The family of any person who dies in police custody is protected by a number of laws. They are able to seek some measure of accountability through a civil claim.
