PHOENIX, ARIZONA (April 21, 2026) – A male pedestrian has tragically died in a Phoenix car accident near the intersection of 27th Avenue and McDowell Road.
Phoenix police officials are saying that the accident took place around 7:23 p.m. on Thursday. A pedestrian was crossing the roadway when they were hit by a vehicle traveling westbound.
Paramedics were called to the scene of the collision to help the victim. He was transported to a local area hospital in critical condition.
Despite life-saving measures, he was later pronounced dead at the hospital. A full investigation into the collision remains ongoing at this time.
Drivers across Arizona have a legal obligation to exercise due care to avoid colliding with any pedestrian in the roadway. Pursuant to Arizona Vehicle Code 28-794, “Notwithstanding the provisions of this chapter every driver of a vehicle shall: 1. Exercise due care to avoid colliding with any pedestrian on any roadway. 2. Give warning by sounding the horn when necessary. 3. Exercise proper precaution on observing a child or a confused or incapacitated person on a roadway.” There are many different factors that could contribute to any pedestrian accident.
If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, this could serve as evidence of negligence. Even if a driver is outside of a marked crosswalk, this does not relieve a driver of their duty of care to take evasive action. Depending on the unique facts of any case, there could be several sources of liability for any pedestrian collision. This is particularly true if a vehicle was being used for some type of commercial purpose at the time of a crash.
Pedestrians lack the protection of enclosed vehicles and are more likely to be seriously injured or killed in the event of a crash. According to the Governor’s Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” A number of actions should be taken after any pedestrian accident.
Pedestrian accidents tend to be very preventable. They also tend to be concentrated along a relatively small number of streets and intersections. Victims of pedestrian accidents are able to seek some measure of accountability through a civil action. This right also extends to the surviving family members of any person who died in a collision. They are able to pursue damages through a wrongful death claim.
We at The Law Offices of John Phebus extend our deepest condolences to the family of the pedestrian killed in this collision. Any person who may have more information about what happened should reach out to the authorities. There needs to be a thorough investigation into what went wrong. Many questions remain unanswered at this time. What was the speed of the driver prior to the crash? Is there a history of pedestrian accidents at this particular intersection?
