LAVEEN, ARIZONA (April 15, 2026) – A female pedestrian identified as Melissa Pennington has tragically died in a Laveen car accident by the intersection of 35th Avenue and Melody Drive.
Maricopa County officials are saying that the accident took place around 7:48 AM on Wednesday. Melissa Pennington was walking near Cesar Chavez Park when she was struck by an out-of-control pickup truck.
Paramedics were called to the scene of the accident to help the injured woman. She was transported to a nearby hospital with very serious and life-threatening injuries.
Sadly, she was later pronounced dead at the hospital. It remains unclear if the driver of the pickup truck will face any citations for the collision.
Drivers have a legal obligation to operate their vehicle in a reasonably safe manner given the prevailing circumstances. This necessitates that they maintain a safe speed at all times and stay within their designated lane of traffic. According to Arizona Vehicle Code 28-729, “a person shall drive a vehicle as nearly as practicable entirely within a single lane and shall not move the vehicle from that lane until the driver has first ascertained that the movement can be made with safety.” There are many different errors that a driver could make that may contribute to a pedestrian collision.
There is a presumption of negligence on the part of any driver that leaves their lane of traffic and collides with a pedestrian outside the roadway. These types of collisions are nearly always the results of drivers that are speeding or otherwise acting negligently. In certain circumstances, liability for collision could extend to multiple parties beyond any specific person determined to be at fault. This is particularly true if a truck was being used for some type of commercial purpose when it crashed.
A number of pedestrians have been seriously injured or killed in preventable collisions each year across Arizona. According to Streets PHX, “The 2020 Pedestrian collision summary includes a reported 560 pedestrian related collisions involving 574 pedestrians, which resulted in 508 pedestrian injuries and 65 pedestrian fatalities.” Victims of pedestrian accidents tend to suffer very serious injuries.
Many of the injuries associated with pedestrian accidents will not be immediately obvious. In many cases, victims do not survive their injuries. Even in these situations, the victim’s surviving family members are still protected by a number of laws. They are able to seek some measure of accountability and justice through a wrongful death claim. Evidence preservation is a critical component in establishing liability for any pedestrian accident.
