MESA, ARIZONA (February 23, 2026) – A 60-year-old pedestrian identified as Salvador Briseno has tragically died in a Mesa car accident near the intersection of Mesa Drive and McKellips Road.
Mesa police officials are saying that the accident took place around 9:00 a.m. on Saturday. The driver of a pickup truck lost control of their vehicle after being stung by bees.
That driver hit Salvador Briseno as he was crossing the road. Firefighters were called to the scene of the collision to help the victim.
He was transported to the hospital with critical injuries. Tragically, Salvador Briseno was later pronounced dead at the hospital.
A full investigation into the collision remains ongoing at this time.
All drivers in Arizona have a legal obligation to use caution to avoid colliding with a pedestrian in the roadway. Pursuant to A.R.S. § 28-792, “the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be in order to yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is on the half of the roadway on which the vehicle is traveling or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.” Drivers should take several actions to avoid colliding with a pedestrian.
If a driver fails to slow down to avoid colliding with any pedestrian, this may be construed as negligence. Depending on the facts of any case, there could be several liable parties for any pedestrian accident. This includes any company or municipal entity operating a truck or other vehicle. Employers in Arizona can be held vicariously liable for the wrongful actions of their employees who were operating within the course and scope of their job duties.
Far too many pedestrians are killed or seriously injured every year in collisions across Arizona and the United States. Increasingly, these accidents are involving larger trucks and SUVs. According to National Public Radio, “The majority of vehicles sold in the U.S. are now SUVs and light trucks, which can have front ends that are often 40 inches or taller. Safety advocates say that’s one reason why pedestrian fatalities are up more than 75% since reaching their lowest point in 2009.” Certain steps should be taken after any pedestrian accident.
Pedestrian accidents are often highly preventable. They tend to involve some amount of driver negligence. In particular, drivers are still expected to operate their vehicles safely even in the event of emergencies. It is important that victims of pedestrian accidents understand their legal rights. They are able to seek some measure of accountability through a civil action. This extends to the family of any pedestrian who dies in a car accident. Surviving family members can pursue action through a wrongful death claim.
We at The Law Offices of John Phebus extend our deepest condolences to the family of Salvador Briseno. Any person who may have more information about what happened should reach out to the police. There needs to be a thorough investigation into what went wrong. Had certain actions been taken, this tragedy may have been averted entirely.
