- Having a BAC between .15 and .20 has a mandatory minimum sentence of 120 days in jail. Although none of that jail time may be suspended, a person may be eligible to serve some of that time on home detention.
- Having a BAC above .20 has a mandatory minimum sentence of 180 days in jail. None of that time is eligible to be suspended, but a person may be eligible to spend some of that on home detention.
